Law No. 6331: Fundamental Training Obligations

Scope of the Law

Turkish Occupational Health and Safety Law No. 6331 was adopted on 30 June 2012 and entered into force in stages. The law covers all public- and private-sector workplaces and employees. Providing OH&S training to employees is among the employer’s fundamental obligations.

Article 17 of the law obliges the employer to ensure that employees receive OH&S training. This training must be provided before work begins, when the job changes, when new equipment or technology is introduced and at regular intervals.

Training Duration and Frequency

Training duration, renewal frequency and method vary according to the workplace’s hazard class, the employee’s role and the subject being addressed. Face-to-face training conditions for job-specific risks must be assessed separately.

The employer must record the training programme, participation, assessment and the documents required by legislation separately and be able to present them during an inspection.

Legal Framework for the Training Format

The current regulation differentiates the training method according to the subject and hazard class. Video and distance learning should be planned, where permitted, together with face-to-face or practical training, assessment and documentation.

Video-based OH&S training may not be sufficient on its own to meet the requirements of the law; it is recommended that it be supported by practical training and assessment. A professional OH&S training film is nevertheless widely used as one of the fundamental building blocks of a training programme.

Acceptance during Inspections

Labour inspectors review training documents during OH&S inspections. Showing a video is not a training certificate on its own. Attendance records, examination or assessment records and the required training certificate must be prepared separately according to the conditions in the regulation.

Replayability: Employees can replay a section they did not understand. This is not possible in classroom training.

Multilingual access: Employees of other nationalities can receive training in their own language. The information obtained by a worker who does not speak Turkish from Turkish-language classroom training is limited; a video prepared in the worker’s own language is much more effective.

Inspection readiness: LMS records make visible who accessed the training and when, the completion rate and the assessment result; official documents and records are kept separately.

Ideal Model: A Hybrid Approach

The most effective OH&S training model uses video and classroom training together. Video communicates theoretical information, while practical exercises and questions and answers take place in the classroom. This hybrid model maximises both information retention and legal compliance.

Conventional Training Cost (Annual)

Trainer fees, venue hire, training materials, the cost of employees being taken away from production and organisational expenses are recurring annual items. At a factory with 500 employees, annual OH&S training costs can easily exceed 100,000 TL.
